Terms of Use
These Terms govern your use of Quell and its related website. By downloading or using Quell, you agree to these Terms and Apple's applicable terms.
1. What Quell is
Quell is a personal tracking and self-guided support tool for people who want to reduce or stop vaping. It provides logging, progress estimates, craving techniques, and quit-plan prompts.
2. Not medical advice
Quell does not provide medical advice, diagnosis, treatment, or emergency support. Content and estimates in the app are for general informational and self-tracking purposes. Consult a qualified healthcare professional for questions about nicotine dependence, withdrawal, medication, or your health.
3. Eligibility
You may use Quell only if you are legally permitted to use the app where you live. Quell is not directed to children or to anyone below the legal age for nicotine products in their jurisdiction.
4. Your data and device
You are responsible for the information you enter and for maintaining access to your device. Quell stores most app data locally. Deleting the app or resetting its data may permanently remove your history. See the Privacy Policy for details.
5. Purchases and subscriptions
Paid features may be offered through Apple's In-App Purchase system. Prices, billing periods, trial terms, and renewal details are shown before purchase.
- Payment is charged to your Apple Account.
- Subscriptions renew automatically unless cancelled through Apple before the renewal date.
- You can manage or cancel subscriptions in your Apple Account settings.
- Refund requests are handled by Apple under its policies.
- Restoring purchases requires the Apple Account used for the original purchase.
6. Acceptable use
Do not misuse Quell, interfere with its operation, attempt unauthorized access, reverse engineer protected parts except where the law permits it, or use the app in a way that violates applicable law.
7. Intellectual property
Quell, its visual identity, app design, text, and original software are owned by Taras Frank or used under license. These Terms give you a personal, limited, non-exclusive, non-transferable right to use the app.
8. Availability and changes
Quell may change, add, or remove features, and may occasionally be unavailable. Reasonable care is taken to keep the app useful and accurate, but uninterrupted availability is not guaranteed.
9. Estimates and accuracy
Streaks, money saved, puffs avoided, nicotine estimates, and similar figures depend on the information you provide and simplified calculations. They are estimates, not clinical measurements or financial guarantees.
10. Liability
To the fullest extent permitted by law, Quell is provided without warranties beyond those that cannot legally be excluded. Taras Frank is not liable for indirect or consequential loss arising from use of the app. Nothing in these Terms limits liability where limitation is prohibited by law, including liability for intent, gross negligence, or injury to life, body, or health.
11. Ending use
You may stop using Quell at any time by deleting the app. Deleting the app does not automatically cancel an Apple subscription. Subscriptions must be managed through Apple.
12. Governing law
These Terms are governed by the laws of Germany, without removing any mandatory consumer protections available in your country of residence.
